Wispex and your privacy

The term ‘Wispex’ mentioned hereafter, refers to the enterprises Wispex Transit NL BV, Wispex Fiscal NL BV, WPXU Holding BV, Wispex BE BV, Wispex DE and Wispex UK.

1. Protection of your personal data

Customers, employees, suppliers and other contacts are entitled to a confidential and careful handling of their personal data on Wispex’s part. Wispex has adjusted its privacy policy for the processing of personal data to the European legislation regulation internationally known as the General Data Protection Regulation (GDPR), known in the Netherlands as AVG. Wispex’s privacy policy is effected through agreements, rules of conduct, and security measures.

2. Personal data used by Wispex

Wispex exclusively uses the personal data which are essential for a good service and business operation. Contact details such as name, first name, initials, titles, gender, position within the company, email address, phone numbers and similar information necessary for communication are processed for contact management and [communication].


If, in additional, other personal data are processed, this is necessary for meeting the commitments of an agreement or a legal obligation. You will be informed of this the moment Wispex contacts you to collect these data.

Special and sensitive personal data

For the creation of customs declarations and for the right to act as a Fiscal and Customs agent it might be possible that an identity document is required for authorisation. An example of this is the representation of a sole proprietorship. These documents are marked as sensitive data which require handling with the utmost care. Confidentiality and concealment from unauthorised access are essential. Wispex has trained its employees and adjusted its security measures to accommodate this.

Access to web portal

Login details such as user names and passwords are distributed and linked to contacts for use of the web portal at portal.wispex.nl. Data from the login sessions are recorded for good and safe operation of the web portal. The data concerned are the IP address, browser data and date and time of your visit.

3. Storage periods

Unnecessary personal data will be removed depending on their legal storage periods. Wispex will maintain the legal storage period of seven years after termination of the service agreement for all its dossiers and corresponding personal data.

4. Services provided by third parties

Wispex enables third parties in order to provide an efficient, proper, and safe service. These third parties are primarily suppliers of software and network management, but also organisations for archive destruction, specialised consultants, and other service providers. The service provided by these third parties is conducted under the responsibility of Wispex.

If these third parties require access to your personal data, a data processing agreement will be made if necessary in which agreements are laid down. These agreements include safe processing and confidentiality of your personal data.

5. Disclosure to third parties

Your personal data will exclusively be used by Wispex for making and processing orders. They will never be disclosed to third parties without your permission, except if there are legal obligations. For example, in the case of a customs inspection, tax authority or the Dutch fiscal investigation service (FIOD).

6. Security

Wispex does everything in its power to ensure your privacy and protect your data. All Wispex employees have a confidentiality obligation and may exclusively process data if they are needed for their work. Our computer systems, computer networks and buildings are secured according to the level which is necessary for the nature and scope of the personal data that are processed. We demand the same level of security from the third parties we work with, like software suppliers and network managers.

7. Breach of security (mandatory reporting of a data breach)

Despite the technical and organisational security measures, a data breach cannot always prevented. Wispex has delegated the privacy protection to the IT department. Employees and suppliers can report incidents which may result in a data breach to this department. A specialised team investigates these reports further and takes those measures which are required to prevent further damage to involved parties and Wispex. According to the law, a data breach that may have significant consequences will be reported to Dutch DPA (Autoriteit Persoonsgegevens) and to the person or persons whose personal data were involved in the data breach.

8. Your rights

The privacy legislation gives involved parties (those whose personal data are processed) the right to ask questions regarding the configuration, processing or use of data, as well as the rectifying, shielding, erasing or denying of already granted permission.
